Counterfeit and Intellectual Property Policy

All the items listed on Wallapop must be authentic and compliant with intellectual property laws. Items sold using a brand logo or brand name must be original and made or manufactured by the brand. 

When you list a product in Wallapop, you are responsible for ensuring all products you list are authentic and do not infringe third party intellectual property rights.

We encourage you to show the authenticity of your itemwhen you list a product. Read below to learn how.  You may be asked to provide proof of authenticity at any time, and failure to do so may lead to your listing being taken down. 

What is the policy?

The following are not permitted to advertise:

• Any product illegally replicated, reproduced, or manufactured. This includes but is not limited to:
  • A bag bearing the brand name or logo that was neither made nor authorized for sale by the brand;
  • A T-shirt printed with copyrighted images;
  • Replicated electronic products;
  • Unauthorized (pirated, duplicated, backup, bootleg, etc.) copies of books, photocopies of books, final thesis books, software programs, videos, films, music, and video games or other protected works or redistribution services for which a license is required.  
• Infringement of intellectual property or industrial rights, including patents, trademarks, copyrights, fakes, or trade secrets.
• Equipment or materials used to make counterfeit items.

Example listings:

Activity must follow Wallapop policy. Otherwise, a range of actions can be imposed including ending or canceling listings or account suspension. Fees paid or payable in relation to listings or accounts on which we take any action may not be refunded or otherwise credited to your account.

 

Why does Wallapop have this policy?

This policy prevents the sale of counterfeit items, which are illegal, and could expose sellers to legal risk. Removing them protects sellers and their buyers from buyer protection claims and financial loss.

 

How to show your item’s authenticity?

All the items listed on Wallapop must be authentic and compliant with intellectual property laws. Therefore, when you list an item, especially a luxury item or items by brands that are popular targets for counterfeiters, please show its authenticity. Otherwise, we might have to delete such a listing.

First, make sure to upload several detailed and high-quality pictures of the product from different angles. Then, to let users see that your item is authentic, please upload pictures of the following:

• Logo
• Tag
• Receipt
• Certificate or certified expert valuation
• Pattern
• Stitches
• Original packaging
• Date code/authenticity code 
• Any other relevant details that would allow you to show the item’s authenticity
