1.- ORGANIZER
Wallapop, S.L. (hereinafter “Wallapop” or the “Organizer”), with Tax ID B-66049057 and registered office at Avenida Meridiana, number 89, 6th floor, 08026 Barcelona, Spain, will carry out the following promotion entitled “Draw of one (1) year free Wallapop PRO “Multicategory” subscription in the Basic 200 Plan” (hereinafter the “Promotion”) in accordance with the terms and conditions described below.
2.- PROMOTION PARTICIPANTS AND CONDITIONS
To be considered a participant in this Promotion, all of the following requirements must be met:
- Be a natural person of legal age (18 years old) or a legal entity;
- To be a resident in Spain;
- Be an active registered user of the “Wallapop” application owned by the Organizer; and
- To contract one (1) Wallapop PRO “Multicategory” subscription between 10.00h on Monday, January 15, 2024 until 23:59h on Friday, January 26, 2024.
(hereinafter referred to as the “Participant” or the “Participants“).
Participation in the Promotion shall not entail any additional cost for the Participant beyond the fulfillment of the requirement indicated in section (iv) above regarding the contracting of one (1) Wallapop PRO “Multi-Category” subscription within the period indicated above. The Participant can find the plans and the respective prices of the PRO “Multi-Category” subscription in section 4 of the present legal bases, as well as by consulting the following link.
Participation in the Promotion implies full acceptance of theseLegal Basis without reservation (hereinafter the “Legal Basis“).
In order to participate in the Promotion, the Participant must comply with the provisions of this section and carry out the actions described in section 4 “Mechanics of the Promotion” of these Legal Basis.
Those persons who violate the provisions of these Legal Basis and, particularly, those who create profiles with incorrect, false or incomplete data in order to obtain a greater number of participations in the Promotion will not be considered as Participants in this Promotion.
Failure to comply with any of the terms and conditions of the Legal Basis or any applicable regulation will imply the impossibility of participating in the Promotion and, if applicable, of receiving the prize obtained in the event of being a winner.
3. DURATION
The Promotion will run from 10:00 a.m. on Monday, January 15, 2024 until 11:59 p.m. on Friday, January 26, 2024 (hereinafter referred to as the “Promotion Period“).
4. MECHANICS OF THE PROMOTION
The Promotion has the following mechanics:
Registered users must purchase one (1) Wallapop PRO “Multicategory” subscription during the Term of the Promotion, regardless of the specific Plan purchased.
The purchase of the Wallapop PRO “Multicategory” subscription implies automatic participation in the Promotion.
The user is informed that the purchase of the Wallapop PRO “Multicategory” subscription implies a financial outlay. The Wallapop PRO “Multi-Category” subscription is divided into different plans.
Below are the different monthly prices of the different plans:
Basic 200 Plan: 39€.
Plan 400: 59€.
Plan 800: 99€.
Plan 1200: 159€.
Plan 2000: 229€.
The user is informed that the only plan to be raffled is the “Basic 200 Plan” whose monthly amount is 39€, as detailed in section 5 of these Legal Basis.
The fact of participating in the Promotion does not guarantee that the Participant is the winner.
Only one participation per person will be admitted.
Once the Promotion has ended, on January 29, 2024, a draw will be carried out exclusively among those users who have subscribed to Wallapop PRO “Multicategory” during the Promotion Period and comply with the rest of the terms and conditions of these Legal Basis (hereinafter, the “Draw”).
Said Draw will be carried out through the “AppSorteos” tool that ensures the random drawing of the winner of the Draw. Through this tool, the Organizer will randomly draw one (1) winner. For this Sweepstakes, no additional Participant will be drawn as a reserve.
5.- PRIZE
The prize will be the following: one (1) free one (1) year subscription to the Wallapop PRO “Multi-Category” Subscription in Plan 200 (hereinafter, the “Prize”).
The Wallapop PRO “Multi-Category” Subscription in the Basic 200 Plan has a monthly price of 39 €. The features of the Basic 200 Plan of the Wallapop PRO “Multi-Category” Subscription can be viewed at the following link.
The Prize will be activated from the month following the acceptance of the Prize by the winning user in the same Wallapop account through which he/she had contracted the Wallapop PRO “Multicategory” subscription service in compliance with requirement (iv) of clause 2 of these Terms and Conditions. The enjoyment of the Prize shall last for an entire cycle (1 year from the activation of the subscription). Thus, by way of example, if the winning user accepts the Prize during the month of February 2024, the enjoyment of the Prize will be from March 2024 to March 2025.
Once this cycle is over, the user’s subscription will automatically become a monthly subscription at a cost of 39€/month. In order not to continue with the monthly subscription, the user must cancel the subscription in accordance with the terms and conditions of the Organizer, which can be found at the following link.
The Prize cannot be exchanged for cash or other prizes, and is personal and non-transferable.
In the event that the winning user, in compliance with requirement (iv) of clause 2 of these Legal Bases, had subscribed to Plan 400, Plan 800, Plan 1200 or Plan 2000, upon accepting the Prize, Plan 200 will be activated in accordance with what is indicated in this section 5 and this will entail the automatic deactivation of the other Plan he/she had subscribed to.
6.- COMMUNICATION OF THE PRIZE TO THE WINNER AND DELIVERY OF THE PRIZE
As of January 29, 2024, the Organizer will contact the Participant who has won the Sweepstakes through the email address associated with his/her Wallapop user. The winner will have a period of five (5) calendar days from the day after the email from the Organizer to reply accepting the Prize. Said acceptance must be sent by replying to the same email in which the winner’s condition is communicated. Once the Prize has been accepted, the winner will receive an explanatory e-mail with instructions on how to enjoy the Prize.
If within five (5) calendar days from the communication of the winner’s status, the Organizer (i) has not received a response from the winner in accordance with the provisions of these Terms and Conditions, (ii) the winner does not comply with the conditions set forth herein, or (iii) expressly rejects the Prize, the winner will lose his/her right to claim the Prize and the Prize will be forfeited in its entirety.
7.- RESPONSIBILITY AND RESERVATIONS
Participation in the Promotion implies knowledge and acceptance of the characteristics, limits and risks of the Internet.
By way of example, but without limitation, the Organizer cannot be held responsible, either directly or indirectly, in the event of malfunctions that may affect the Internet, configuration problems or problems linked to a specific browser. Nor can the Organizer be held liable, either directly or indirectly, for any damage caused to the Participants, their computer equipment and/or the data stored therein.
The Organizer reserves the right to take any legal action against any person who performs any act likely to be considered as manipulation and/or falsification of the Promotion.
The Organizer disclaims any responsibility for the notification not being correctly received in the inbox or in the expected reception conditions and it will be the winner’s responsibility to ensure and/or verify that the Organizer’s communications are not referred by his/her e-mail provider to the spam or unwanted mailbox.
The Organizer reserves the right for any reason to cancel, delay, interrupt, extend or modify the Promotion in whole or in part without being responsible for it, informing in any case its Participants.
The information provided by each Participant will be used to manage his/her participation in the Promotion and, if applicable, to inform him/her if he/she is a winner and to send him/her the Prize.
8.- EXCLUSION
The Organizer reserves the right to exclude from the Promotion and participation in the Sweepstakes all those Participants who, in its opinion, are in breach of any condition of participation included in the present Legal Bases without prior notice. If the Organizer evidences that any Participant does not comply with the requirements demanded in the Legal Bases or the data provided were not valid, his/her participation will be considered null and void and he/she will be automatically excluded from the Promotion.
Likewise, any Participant who uses means that are not permitted or who does not comply with the terms and conditions of the Wallapop application or any applicable regulations will be excluded from any participation.
The exclusion of a Participant, whatever the cause, entails the loss of all rights derived from his or her status as such.
9.- PROTECTION OF PERSONAL DATA
In accordance with the applicable regulations on data protection, specifically, Organic Law 3/2018, of December 5, on the protection of personal data and guarantee of digital rights and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, the Participant is informed that, for the participation in the Promotion, the personal data he/she provides to participate will be processed by Wallapop, S.L., in its capacity as data controller, for the purposes of:
(i) Managing the development of the Promotion, your participation and being able to keep you informed of the Promotion (including the communication of the Prize and the management thereof) including by electronic means. This treatment is based on the consent you provide when participating in the Promotion.
(ii) To comply with legal obligations applicable to Wallapop, in particular, tax obligations. This processing is based on the existence of a legal obligation incumbent on the controller.
The Participant’s personal data will be communicated (i) to service providers necessary for the development of the Promotion, in their capacity as data processors, and (ii) in the case of the winner, his/her data will be communicated to public authorities in the exercise of their functions (e.g., Tax Agency for the settlement of the corresponding taxes).
Participants may exercise their rights of access, rectification, deletion, limitation of processing, opposition, portability of their personal data provided, as well as the right not to be subject to automated individual decisions, by sending a request to the following e-mail address: privacidad@wallapop.com. Likewise, when they deem it appropriate, they may file a complaint with the Spanish Data Protection Agency.

10.- LEGISLATION AND COMPETENT JURISDICTION
These Legal Bases shall be governed by and construed in accordance with Spanish law. For all matters relating to the interpretation, fulfillment and execution of the Legal Bases, the Organizer and the Participants formally submit to the jurisdiction and competence of the Courts and Tribunals of Barcelona. In any case, the Participant may bring his/her action before the courts corresponding to the domicile of the Organizer, or before the courts of the place where the Participant is domiciled.
